TERMS

1. SCOPE

  

Thank you for visiting ontoo.ch. These Terms and Conditions (“Terms”) apply to the contractual relationship of Ontoo Gmbh (referred to as “Ontoo”) headquartered in 8700 Küsnacht, Switzerland and the customer (referred to as “customer”) and retail partner (referred to as “retail partner”). The applicable version is the one at the time of the conclusion of the contract.

  

The company owns and operates the ontoo.ch online shop, offering jewellery and fashion and organizes physical events with commission-based services as well.



These terms and conditions are an integral part of the contract and apply to the above-mentioned areas and other services that the company provides directly and indirectly to the customers. Exceptions shall only be valid if they have been expressly agreed upon in writing between Ontoo and the customer.

  

  

2. SALES OF GOOD    

2.1 CONCLUSION OF CONTRACT

  

By ordering any of our products or working with us on commission basis, you agree to be bound by these terms & conditions. A sales contract between the parties is concluded as soon as the customer receives the order confirmation from Ontoo.

  

2.2 OBJECT OF PURCHASE

  

The object of purchase shall be the items ordered by the customer. Due to its natural materials made by hand, minor deviations from the merchandise shown in the online store or on flyers/photos may apply.

Ontoo has the right to change the products, scope, price, etc. of the online offer at any time.

   



2.4 PURCHASE PRICES

  

All prices seen or quoted by customer service are in Swiss Francs (CHF) and applicable as in the online store at time of the order, excluding VAT. The total amount to be paid by the customer is listed at checkout. It consists of the purchase price, any shipping costs and value-added tax (VAT).

The price may vary according to gemstone and gold color as well as market prices.

  

All shipping rates are calculated through FedEx, DHL and locally through the Swiss Post and include insurance for the full value to protect your merchandise. In addition, Ontoo is responsible for international taxes and import duties of the destination country. 

 

Ontoo may cancel orders and process refunds due to any pricing errors. 



  

2.5. PAYMENT

  

The customer is obliged to pay the invoiced amount before shipment of online orders or receiving of items at physical events via Paypal, credit card, bank transfer or cash. 

 

2.6 SHIPPING AND DELIVERY

As a rule, the goods shall be shipped to the address specified by the customer. The use and risk of the purchased goods shall pass to the postal company at the time of delivery to the postal company with the full value being insured.

Due to the high price point of the product, if an item is lost in transit the customer will receive a credit to the original value of the item. This can only be actioned once Ontoo is satisfied by the results of the search.



As a rule, the goods are dispatched within 5 working days of the order. Ontoo is not liable for any delay in delivery.

  

All orders require a signature upon delivery.




 

3. CONTRACTUAL TERMS / COMMISSION BASED SERVICES

3.1 OBLIGATIONS OF THE COMPANY

  

Ontoo will fulfil its obligation to provide the agreed products or commission as agreed on with the retail partner.

  

 

 

​3.2 OBLIGATIONS OF THE CUSTOMER  

3.2.1. CLIENT RESPONSIBILITY

The retail partner is fully responsible for the secure storage of any Ontoo merchandise in their custody. Any loss or damage has to be refunded to Ontoo at the agreed upon price (commission rate).

 

Ontoo assumes no responsibility for errors made with the sales price by the retail partner. 

 

3.3 COMMISION FEE

 

By selling ONTOO merchandise or making use of ONTOO’s pop up venues, the retail partner agrees to pay the agreed fee. The fees and the terms of payment are as agreed upon individually with the retail partner in advance. 

 

Unless otherwise stated, the fee does not include value-added tax.

 

Return policies and commission fees are as agreed on with the retail partner.

  




4. WARRANTY, DEFECTS AND RETURNS

4.1 DEFECTS

  

If there’s an issue with the ordered item, please contact our customer service team at contact(at)ontoo.ch within 10 days after receival.

  

  

4.2 RETURNS



The return period is 10 days and starts as soon as you receive your order and will be subjected to a comprehensive quality inspection. Returns can only be made with Ontoo’s approval. 

Please note we can not accept returns of customized or personalized items. 



4.3 DELIVERY WARRANTY



The company strives for a timely delivery.  However, Ontoo cannot guarantee the uninterrupted and trouble-free functioning of postal services and production lines.  For any delay in delivery or during the time of a possible repair, the customer has no claim to a replacement product or refund.

6. PERSONAL INFORMATION

  

All personal information you provide us with or that we obtain will be handled by Ontoo and their companies only. The personal information you provide will be used to ensure deliveries to you, to provide offers and information on our products and services to you. The information you provide will not be shared with other third parties.

 

You always have the right to inspect the information held about you or request to delete or correct the information. By accepting Ontoo terms, you agree to the above.

  

7. CHANGES IN TERMS

  

The company may change the terms and conditions without prior notice at any time. The new version comes into effect by publication on the company’s website.

Unless the customer has agreed to a newer version of the terms and conditions, the version of the online terms & conditions at time of the purchase is valid and applies to the customers. 

  

8. APPLICABLE LAW / JURISDICTION

  

These terms and conditions are subject to Swiss law, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. 

For all disputes in connection with the contractual relationship between the parties, the exclusive place of jurisdiction shall be Küsnacht ZH, to the extent permitted by law.

  

9. TAKING EFFECT

  

These terms take effect on January 1, 2022.

Future changes and additions are possible at any time.
