Terms & Conditions

Welcome to ontoo.ch, the official online store of Ontoo GmbH ("Ontoo," "we," "us"), headquartered in 8700 Küsnacht, Switzerland. These Terms and Conditions ("Terms") govern the relationship between Ontoo and its Customers ("Customer") and Retail Partners ("Retail Partner"). By placing an order or otherwise engaging with Ontoo, you agree to these Terms in full.
1. Scope
These Terms apply to purchases made via ontoo.ch, commission-based partnerships, retail events, and any other service provided by Ontoo directly or indirectly. Any exceptions must be agreed in writing with Ontoo.
2. Access to the Online Store
The online store offer is intended exclusively for adult consumers able to provide a valid delivery address. A consumer within the meaning of this provision is any natural person concluding a contract for private, non-commercial purposes. Purchasing from the online store for commercial resale is prohibited, unless otherwise agreed in writing with Ontoo.
3. Sale of Goods
A binding sales contract is established once the Customer receives an order confirmation from Ontoo.
Products are handcrafted using natural materials (gold, silver, precious and semi-precious stones). Minor variations from online images, due to the handcrafted nature of the materials, may occur and do not constitute a defect. Ontoo reserves the right to update products, prices, or availability at any time.
All prices are stated in Swiss Francs (CHF) and include VAT, unless otherwise stated. The total price shown at checkout includes the product price, VAT, and shipping costs. Prices may vary depending on gemstone type, gold tone, and raw material market fluctuations. Ontoo reserves the right to cancel and fully refund any order affected by a pricing error.
4. Retention of Title
Delivered goods remain the property of Ontoo until full and unconditional payment of the corresponding invoice amount has been received. For Customers domiciled or registered in Switzerland, Ontoo is entitled to make a corresponding entry in the retention of title register.
5. Payment
Payment must be made before shipment or collection, via PayPal, credit card, bank transfer, or, at physical events, cash.
6. Shipping and Transfer of Risk
Orders are shipped to the address provided by the Customer. Ownership and risk transfer to the Customer upon handover to the carrier (Swiss Post, FedEx, or DHL). All shipments are insured for their full value. If an item is lost in transit, Ontoo will issue a credit or replacement once the carrier's investigation is complete.
Standard processing time is 5 business days from order confirmation. Signature is required for all deliveries. Ontoo is not liable for delays caused by the carrier or by customs authorities.
7. Commission-Based Partnerships with Retail Partners
Ontoo provides merchandise or commission-based services to Retail Partners as specified in the written agreement between the parties.
Retail Partners are responsible for the secure storage of Ontoo merchandise. Any loss or damage must be reimbursed to Ontoo at the agreed price. Retail Partners are responsible for correct pricing during sales.
Retail Partners pay the agreed commission fee in advance. Commission fees are exclusive of VAT unless otherwise stated. Return policies and commission structures are defined individually with each partner.
8. Legal Warranty, Returns & Defects
New products purchased are covered by the Swiss statutory warranty of two years from delivery, in accordance with the Swiss Code of Obligations (Art. 197 et seq. CO). In the event of a defect, contact contact@ontoo.ch with the order number and a description of the issue.
In addition to the legal warranty, Ontoo voluntarily accepts returns within 10 days of receipt, subject to approval. Items must pass a quality inspection before a refund or exchange is issued. Customized or made-to-order items are excluded from voluntary returns, without prejudice to the legal warranty for defects. Return shipping costs are the Customer's responsibility unless otherwise agreed, or unless the return is due to a product defect.
For Customers ordering from a European Union country, the 14-day right of withdrawal under EU distance-selling regulations also applies, to the extent such regulations are applicable.
Ontoo strives for timely delivery but cannot guarantee uninterrupted postal or production services. Delays or repairs do not entitle the Customer to a refund or replacement, except as required by law.
9. Materials & Authenticity
Ontoo guarantees that the precious metals and gemstones used correspond to the product description. Upon request, and where available, Ontoo provides certification regarding gold purity or stone origin. Any dispute regarding the authenticity of materials must be reported within the timeframe set out in Section 8 and will be verified by Ontoo or an independent expert.
10. Intellectual Property
All content on ontoo.ch, including text, images, designs, logos, and trademarks, is owned by or licensed to Ontoo and is protected under Swiss and international intellectual property law. Any unauthorized reproduction, distribution, or use is prohibited without Ontoo's prior written consent.
11. Data Protection
Personal data is processed in accordance with the Swiss Federal Act on Data Protection (FADP) and its implementing ordinance. For full details, please refer to our Privacy Policy at [LINK].
In summary, personal data collected is used solely for order processing and is not shared with third parties except for shipping or payment purposes, or as required by law. Customers may request access, correction, restriction of processing, or deletion of their data at any time by writing to contact@ontoo.ch. Newsletter subscription is optional and can be cancelled at any time.
12. Changes to These Terms
Ontoo reserves the right to update these Terms at any time. The version in effect at the time of the order applies.
13. Governing Law & Jurisdiction
These Terms are governed by Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction is Küsnacht ZH, Switzerland, as far as permitted by law.
Consumer Customers may also contact the Swiss E-Commerce Ombudsman's Office for an out-of-court dispute resolution procedure.
By placing an order with Ontoo, the Customer confirms having read, understood, and accepted these Terms and Conditions.
